South Africa Severance Pay Calculator
If you are facing retrenchment (dismissal for operational requirements) in South Africa, you are entitled to certain minimum payments by law. This calculator helps you estimate your statutory severance pay, notice pay, and payment for accrued annual leave.
What is Severance Pay?
Severance pay is a lump sum payment made by an employer to an employee who is dismissed due to the employer's operational requirements, such as redundancy, restructuring, or economic reasons. The Basic Conditions of Employment Act (BCEA) sets the minimum entitlement.
How is Severance Pay Calculated?
The law states that you must receive at least one week's remuneration for every full year of completed service. Only full years count. For example, if you worked for 5 years and 7 months, you are entitled to 5 weeks' pay.
Important Exception: You lose your right to severance pay if you unreasonably refuse an offer of suitable alternative employment from your employer.
Notice Pay
You are also entitled to a notice period before your employment ends, based on your length of service:
- Less than 6 months: No notice required.
- 6 months to 1 year: 1 week's notice.
- 1 year to 4 years: 2 weeks' notice.
- More than 4 years: 4 weeks' notice.
If your employer does not require you to work during this notice period, they must pay you "payment in lieu of notice." This calculator allows you to indicate if you will receive this lump sum payment. If you work during the notice period, you will receive your normal salary instead and should select 'No' for that input.
Accrued Annual Leave Pay
You must be paid out for any annual leave days you have accrued but not taken. The payment is calculated based on your daily rate of pay (weekly remuneration divided by 5 working days).
Example Calculation
Let's say Thandi started work on 20 October 2021 and is retrenched on 20 October 2026. She earns R5,000 per week, has 10 days of leave owed, and will be paid in lieu of her 4-week notice period.
- Years of Service: 5 full years.
- Severance Pay: 5 years × 1 week/year = 5 weeks. 5 weeks × R5,000 = R25,000.
- Notice Pay: 4 weeks × R5,000 = R20,000.
- Leave Pay: 10 days × (R5,000 / 5) = 10 × R1,000 = R10,000.
- Total Package Before Tax: R25,000 + R20,000 + R10,000 = R55,000.
This R55,000 will be taxed as follows: the R25,000 severance pay and R20,000 notice pay are combined and taxed as a 'retirement fund lump sum benefit' at special SARS rates. The R10,000 leave pay is taxed as ordinary income.
Taxation of Retrenchment Packages
It is crucial to understand the different tax treatments:
- Severance Pay & Notice Pay (if paid as lump sum): Taxed as a 'retirement fund lump sum benefit'. SARS provides a separate tax table for these benefits, which is generally more favorable than normal income tax rates.
- Accrued Leave Pay: Taxed as ordinary income, added to your other earnings for the year.
Consult the latest SARS guides or a tax professional to understand your final net payment.
Next Steps and Documentation
After calculating your estimated package, your employer should provide a formal Retrenchment Notice outlining the reasons, timeline, and details of your entitlements. You can use our Retrenchment Notice template to ensure all required information is documented. Following that, a formal Employment Termination Letter will be issued to confirm the final settlement.
Remember, the amounts calculated here are the legal minimums. Always check your employment contract, any applicable bargaining council agreement, or company policy, as these may provide for more generous benefits.
