Overtime Pay in South Africa
Overtime work refers to hours worked beyond an employee's ordinary hours of work. In South Africa, the Basic Conditions of Employment Act (BCEA) sets the legal framework for overtime, including payment rates and maximum limits. Both employers and employees need to understand these rules to ensure fair compensation and compliance with the law.
How is Overtime Calculated?
The calculation starts with determining the employee's ordinary hourly rate. If you know the monthly salary, the formula is: (Monthly Salary × 12) / (52 × Ordinary Hours per Week). This hourly rate is then multiplied by specific legal multipliers to get the overtime rates.
The BCEA prescribes the following overtime rates:
- Weekdays (Monday to Saturday): 1.5 times the ordinary hourly rate.
- Sundays: The rate depends on whether Sunday is part of the employee's ordinary working week. If it is, the rate is 1.5 times. If it is not, the rate is 2 times the ordinary hourly rate.
- Public Holidays: 2 times the ordinary hourly rate.
To find the total overtime pay, multiply the hours worked in each category by its respective rate and sum the results.
Important Exceptions and Agreements
Two critical factors can change the outcome:
- Earnings Threshold: The Minister of Employment and Labour sets an annual earnings threshold. Employees earning above this amount (R254,371.67 per year as of 2025) are exempt from several sections of the BCEA, including the ordinary overtime provisions (Sections 9, 10, 11, 12, 14, 15, 16, 17(2), and 18(3)). For these employees, overtime pay is governed solely by their employment contract. Note: The threshold for 2026 had not been published at the time of writing.
- Time Off in Lieu: By written agreement, an employer may compensate an employee for overtime with paid time off instead of additional pay. This time off must be granted within one month of the overtime being worked.
Worked Example
Let's consider Thabo, who earns a monthly salary of R20,000 and works 45 ordinary hours per week. He is not exempt from the BCEA. In one week, he works 3 hours of overtime on a Tuesday, 3 hours on a Wednesday, and 4 hours on a Sunday. He does not ordinarily work on Sundays. This respects the daily limit of 3 hours.
First, calculate his ordinary hourly rate: (R20,000 × 12) / (52 × 45) = R102.56 per hour.
- Weekday overtime (6 hours): R102.56 × 1.5 = R153.84 per hour. Total: 6 × R153.84 = R923.04
- Sunday overtime (4 hours): R102.56 × 2.0 = R205.12 per hour. Total: 4 × R205.12 = R820.48
Thabo's total overtime pay for the week is R923.04 + R820.48 = R1,743.52.
Common Scenarios
Shift Workers: Employees who regularly work Sundays as part of their shift pattern are only entitled to 1.5 times their rate for Sunday overtime.
High-Earners: Managers or professionals earning above the threshold should check their contract. While the BCEA may not apply, their contract might still guarantee overtime pay at a specified rate.
Maximum Limits: Remember, the law limits overtime to 10 hours in a week and 3 hours in a day. This calculator will warn you if the entered hours suggest these limits are being exceeded. Consistently exceeding these limits is illegal.
Next Steps: Documenting Overtime
To ensure clarity and legal compliance, it is highly recommended to formalize overtime arrangements. An Overtime Agreement is the perfect document for this. It specifies the definition of overtime, the applicable compensation rates for different days, the maximum allowable hours, and the procedure for obtaining approval before working overtime. Having this agreement in place protects both the employer and the employee and helps prevent disputes.
