Philippines Overtime and Night Differential Pay
Employees in the Philippines are entitled to additional compensation when they work beyond the standard eight-hour workday or during night hours. The rules for calculating this extra pay are defined in the Philippine Labor Code. This calculator helps you determine the correct amount for overtime and night differential pay based on your regular hourly rate, the hours you worked, and the type of day.
How Overtime Pay is Calculated
Overtime pay is calculated by applying a premium to your regular hourly rate. The premium percentage depends on the type of day you worked overtime:
- Ordinary Working Day: Overtime hours are paid at 125% of your regular hourly rate. This means you get your regular pay plus an additional 25% premium for each overtime hour.
- Rest Day or Special Non-Working Day: Overtime hours are paid at 130% of your regular hourly rate. This is your regular pay plus a 30% premium for each overtime hour.
- Regular Holiday: The first 8 hours are paid at 200% of your regular rate. Overtime hours on a holiday are paid at 260% of your regular hourly rate. This is calculated as the 200% holiday rate plus a 30% overtime premium applied to that holiday rate.
The formula is: Overtime Pay = Overtime Hours × [Regular Hourly Rate × Holiday Multiplier × (1 + Premium Rate)].
How Night Differential Pay is Calculated
Night differential is an additional pay for work performed between 10:00 PM and 6:00 AM. The law mandates a premium of 10% of the applicable hourly rate for every hour worked during this period. The applicable rate depends on the context:
- If no overtime hours were worked, the applicable rate is your regular hourly rate (or the holiday rate of 200% if it's a Regular Holiday).
- If overtime hours were worked, the applicable rate for all night hours is your overtime hourly rate (which already includes the overtime premium and holiday multiplier).
The formula is: Night Differential Pay = Night Hours × (Applicable Hourly Rate × 10%).
Example Calculation
Let's say Maria has a regular hourly rate of PHP 100. She worked 3 hours of overtime on an ordinary Wednesday, and 2 of those hours were between 10 PM and 6 AM.
- Overtime Premium Rate: 25% for an ordinary day.
- Overtime Hourly Rate: PHP 100 × (1 + 0.25) = PHP 125 per hour.
- Applicable Rate for Night Hours: Since overtime hours exist, the applicable rate is the overtime rate: PHP 125.
- Overtime Pay: 3 hours × PHP 125 = PHP 375.
- Night Differential Rate: PHP 125 × 10% = PHP 12.50 per hour.
- Night Differential Pay: 2 night hours × PHP 12.50 = PHP 25.
- Total Additional Pay: PHP 375 + PHP 25 = PHP 400.
Maria should receive PHP 400 in addition to her regular wages for that day.
Common Scenarios
Overtime on a Rest Day: If you are called to work on your scheduled day off, your overtime hours are paid at the higher 30% premium rate. The night differential is calculated based on that overtime rate for any night hours.
Night Shift on a Holiday: If you work your regular night shift on a Regular Holiday (e.g., 5 hours between 10 PM and 6 AM) with no overtime, your base pay for those hours is 200% of your regular rate. The night differential is then 10% of that holiday rate.
Overtime on a Holiday: Working overtime on a regular holiday means your overtime rate is 260% of your regular rate (200% base + 30% premium). If any of those hours are at night, the 10% night differential is calculated on top of that 260% rate.
Next Steps: Documenting Your Pay
To ensure your compensation terms, including overtime and night differential rates, are clearly defined, it is advisable to have a written employment contract. This protects both the employer and the employee. After calculating your pay, you may want to review or prepare an Employment Contract to formalize these terms.
