TDS on Rent in India

Tax Deducted at Source (TDS) on rent is a mechanism where a tenant (the deductor) is required to deduct a percentage of the rent before making payment to the landlord (the deductee). This deducted tax must then be deposited with the Indian government. The primary sections governing TDS on rent are Section 194-I (for general rent) and Section 194-IB (for rent paid by individuals or HUFs for residential property).

Who Needs to Deduct TDS?

Any person (which includes individuals, HUFs, companies, firms, etc.) paying rent is potentially liable to deduct TDS. The applicability depends on several factors:

  • Type of Payer: Whether the tenant is an Individual/HUF or a Business entity (company, partnership firm, etc.).
  • Type of Property & Asset: Whether the property is residential, commercial (land/building/furniture), or plant/machinery/equipment.
  • Rent Amount: The monthly rent amount.

Current Thresholds and Rates (FY 2026-27)

The rules differ based on the payer, property type, and asset category:

Payer TypeProperty / Asset TypeRelevant SectionMonthly Rent ThresholdTDS Rate (if PAN provided)TDS Rate (if PAN NOT provided)
Individual or HUFResidential194-IBAbove ₹50,0005% of Annual Rent*20%

Business EntityCommercial (Land/Building/Furniture)194-INo threshold10%20%
Business EntityPlant/Machinery/Equipment194-INo threshold2%20%

* Under Section 194-IB, TDS is 5% of the annual rent (or total rent for the year) and is deducted only once, in the last month of the tenancy or the last month of the financial year. The monthly calculation shown is for estimation.

The higher rate of 20% in the absence of the landlord's PAN is mandated by Section 206AA of the Income-tax Act.

How is TDS on Rent Calculated?

The calculation follows these steps:

  1. Determine if TDS is Applicable: Check if the payment falls under the thresholds mentioned above.
  2. Identify the Correct TDS Rate: Use the rate from Section 194-I or 194-IB if the landlord has provided their PAN. Use 20% if the PAN is not provided.
  3. Calculate Monthly TDS (Estimate): Apply the rate to the monthly rent amount for planning purposes.
Monthly TDS = Monthly Rent × (TDS Rate / 100)
  4. Pay the Landlord: Deduct the TDS amount from the rent and pay the net amount to the landlord.
Net Payment = Monthly Rent − Monthly TDS

Example Calculation

A private limited company rents office equipment (plant/machinery) for ₹80,000 per month. The landlord has provided a PAN.

  • Monthly Rent: ₹80,000
  • Payer: Business
  • Asset Type: Plant/Machinery/Equipment
  • TDS is always applicable for business payers.
  • Landlord has PAN, so the Section 194-I rate for plant/machinery is 2%.
  • Monthly TDS = ₹80,000 × 2% = ₹1,600.
  • Net Payment to Landlord = ₹80,000 − ₹1,600 = ₹78,400.
  • The company must deposit ₹1,600 monthly with the government.

Compliance Steps for the Tenant

Deducting TDS is only the first step. The tenant must also:

  1. Obtain a Tax Deduction and Collection Account Number (TAN) if they are not an individual or HUF. Individuals and HUFs deducting TDS only under Section 194-IB are exempt from obtaining TAN.
  2. Deposit the TDS by the 7th of the following month using Challan 281.
  3. File Quarterly TDS Returns (Form 26Q) by the due dates.
  4. Issue a TDS Certificate (Form 16C) to the landlord within a specified period, which the landlord can use to claim credit for the tax deducted.

After Calculating Your TDS

Once you know how much TDS to deduct, you should properly document the transaction. For regular payments, a Rent Receipt should be issued by the landlord, but you can also prepare one for your records. For a new rental agreement, ensure the Residential Lease Deed or Commercial Lease Agreement clearly states the rent amount and acknowledges the tenant's responsibility to deduct TDS, if applicable.

Frequently asked questions

Do I need to deduct TDS if I am an individual paying rent of ₹40,000 per month?

No. For an individual or HUF paying rent for residential property, TDS under Section 194-IB is only required if the monthly rent exceeds ₹50,000 (for FY 2026-27). Since ₹40,000 is below this threshold, no TDS deduction is required.

What is the TDS rate if my landlord does not have a PAN?

If the landlord does not provide their PAN, you are required to deduct TDS at the rate of 20%, regardless of the property type or the applicable section (194-I or 194-IB). This is under Section 206AA of the Income-tax Act.

As a company, do I deduct TDS on all rent payments, even small amounts?

Yes. For all business entities (companies, firms, etc.), there is no minimum threshold for TDS on rent under Section 194-I. TDS must be deducted on every rent payment. The rate depends on the asset type: 10% for land/building/furniture and 2% for plant/machinery/equipment (if PAN is provided).

When do I have to deposit the TDS deducted from rent?

For monthly deductions under Section 194-I, the deducted TDS must be deposited with the government by the 7th day of the following month in which the deduction was made. For TDS under Section 194-IB (individuals/HUF on residential rent above threshold), it is deducted once per year and deposited accordingly.

Do I need a TAN to deduct TDS on rent as an individual?

If you are an individual or HUF deducting TDS only on residential rent under Section 194-IB (i.e., rent above ₹50,000 per month), you are not required to obtain a TAN and can use your PAN. However, if you are deducting TDS under Section 194-I (e.g., for commercial rent or plant/machinery), a TAN is required.

How is TDS calculated under Section 194-IB for residential rent?

Under Section 194-IB, TDS is 5% of the annual rent (or the total rent payable for the financial year). It is not deducted monthly. The deduction is made only once, at the time of credit of rent for the last month of the tenancy or the last month of the financial year, whichever is earlier. The calculator shows a monthly estimate for planning.
