Maternity Leave in India
The Maternity Benefit Act, 1961, amended in 2017 and now integrated into the Code on Social Security, 2020, provides paid leave to women employees for childbirth and childcare. The law aims to protect the health of the mother and child. Understanding your entitlement and planning your leave dates is crucial for a smooth transition.
How is Maternity Leave Calculated?
The total leave entitlement depends on the number of living children and the type of event (childbirth, adoption, surrogacy). For the first two children, a woman is entitled to 26 weeks of paid maternity leave. For the third child and onwards, the entitlement is 12 weeks. In case of adoption or surrogacy (for a commissioning mother), the leave is 12 weeks for a child below three months of age.
You can choose to take a portion of this leave before the expected date of delivery or adoption, but the law sets a maximum to ensure sufficient postnatal leave. For a 26-week entitlement, you can take up to 8 weeks before delivery. For a 12-week entitlement (third child onwards, adoption, commissioning mother), you can take up to 6 weeks before the event. This ensures the mandatory minimum of 6 weeks of leave after delivery or the child's handover.
Example Calculation
Priya is expecting her first child on January 15, 2027. She plans to take 6 weeks of leave before her due date. Her entitlement is 26 weeks.
- Total Leave: 26 weeks.
- Prenatal Leave: 6 weeks.
- Postnatal Leave: 26 - 6 = 20 weeks.
- Leave Start Date: 6 weeks before January 15, 2027 = December 4, 2026.
- Leave End Date: 20 weeks after January 15, 2027 = June 3, 2027.
Priya's total leave will span from December 4, 2026, to June 3, 2027, covering 182 calendar days.
Another Example: Third Child
Meena is expecting her third child on March 10, 2027. She plans to take the maximum allowed prenatal leave. Her entitlement is 12 weeks.
- Total Leave: 12 weeks.
- Prenatal Leave: 6 weeks (maximum allowed for a 12-week entitlement to ensure 6 weeks postnatal).
- Postnatal Leave: 12 - 6 = 6 weeks.
- Leave Start Date: 6 weeks before March 10, 2027 = January 27, 2027.
- Leave End Date: 6 weeks after March 10, 2027 = April 21, 2027.
Meena's leave will be from January 27 to April 21, 2027.
Common Scenarios
- First or Second Child: You are entitled to the full 26 weeks. Plan your prenatal leave (up to 8 weeks) based on your health and work commitments. The remaining weeks (at least 18) are for postnatal care.
- Third Child or More: Entitlement reduces to 12 weeks. You can take up to 6 weeks before delivery, leaving the mandatory 6 weeks after.
- Adoption: If you adopt a child below three months, you get 12 weeks of leave from the date the child is handed over to you. You can choose to start your leave up to 6 weeks before this date, but typically the entire leave is taken after the child's arrival.
- Commissioning Mother: In case of surrogacy, the biological (commissioning) mother is entitled to 12 weeks of leave from the date the child is handed over to her. The same prenatal limit of 6 weeks applies if she wishes to start leave early.
Important Considerations
The leave is paid at your average daily wage. You must have worked for at least 80 days in the 12 months preceding your expected date of delivery to be eligible. The law also provides for medical bonus and nursing breaks. In case of miscarriage or medical termination of pregnancy, a woman is entitled to 6 weeks of paid leave immediately following the event.
Next Steps: Requesting Your Leave
Once you have calculated your dates, you should formally notify your employer, ideally at least one month before your planned start date. A well-drafted leave application ensures clarity and helps in work handover. You can use a Letter Requesting Parental Leave to communicate your leave plan, start and end dates, and any handover arrangements to your manager and HR department. This document helps structure your request professionally, covering essential details like your employee information, leave type, duration, and plans for work coverage during your absence.
